Scott has substantial experience advocating for his clients in a variety of high-stakes, complex litigation matters including fraud and breach of contract actions, alleged violations of RICO, and various federal and state consumer protection laws.  His practice includes representing fiduciaries and beneficiaries in sophisticated trusts and estates litigation and defending large, international law firms and their lawyers in professional liability claims.  Scott also represents parties in breach of fiduciary duty and partnership actions and has extensive experience representing companies in responding to and defending against investigations and lawsuits by Attorneys General.

Prior to joining Elman Freiberg PLLC, Scott worked at Moses & Singer LLP for almost two decades, and before that, at Hodgson Russ LLP, and Wilson Elser, representing parties in complex litigations.

Among other civil volunteer responsibilities, Scott has served as President of the Board of Education of the Scarsdale Union Free School District, and as a member of the Board of Directors of the Crohn’s & Colitis Foundation – Fairfield/Westchester Chapter, Westchester Reform Temple, Zeta Beta Tau Fraternity, Scarsdale Schools Education Foundation, and Scarsdale Youth Soccer Club.

Prior to attending law school, Scott worked in Washington, D.C, in the legislative offices of Congressman Gary Ackerman.

Selected Experience

  • Represented a closely held jewelry company in the defense of a lawsuit concerning claims of an oral agreement of a partnership agreement, and successfully resolved the matter without the need for a trial.

  • Representing the income beneficiary in a complex and contested estate regarding significant real estate assets.

  • Convinced an arbitration panel to dismiss all claims for compensatory and punitive damages for alleged fraud by a leading luxury real estate auction company.

  • Representing AmLaw 100 firm in federal court against allegations of aiding and abetting violations of New York State and New York City human rights laws.

  • Defended an iconic performance art company in a litigation in the Supreme Court, New York County against claims of breach of contract, breach of fiduciary duty, and unjust enrichment and seeking an accounting, and successfully resolved the matter without the need for a trial.

  • Represented an alternative investment advisory firm in an arbitration for the breach of a securities purchase agreement, and successfully resolved the matter without the need for a hearing.

  • Defending global law firm in federal court against claims of conspiracy to commit fraud and aiding and abetting fraud brought by judgment creditors against judgment debtor and others, including the law firm.

  • Successfully prosecuted and defended multiple litigations concerning breach of contract, fraud, employment, and lien foreclosure issues for New York City-based real estate and construction services companies.

  • Represented an international start-up company in the sports ticket and leisure travel industry in a dispute with a minority owner, and successfully resolved the matter without the need for litigation in the United States or in Europe.

  • Obtained a temporary restraining order and preliminary and permanent injunctions for an insurance brokerage company in non-competition, non-solicitation, and misappropriation of confidential information and trade secret action.
